Terms of Use (User Agreement)

Attention! Please read these Website Terms of Use (hereinafter, the “Terms”) carefully before using www.azfilter.az (hereinafter, the “Website”). If you do not agree with the Terms, you may voluntarily leave the Website. Otherwise, your visit to the Website and any actions taken on it constitute your full and unconditional acceptance of the Terms.
This Website is protected by copyright and trademarks.

Definitions and Terms

In these Terms, the following definitions apply:

 

“Azfilter Group” LLC / Company / Seller — Limited Liability Company “Azfilter Group” (VOEN: 1007732031, Registered address: Baku, Khagani Rustamov St. 4. Head office: Baku, Ahmed Rajabli St. 23L).

Site — the website azfilter.az, owned by “Azfilter Group” LLC and belonging to the “Azfilter” retail chain.

User — a legally capable individual of full age who accesses and continues to use the Site in accordance with these Terms.

User Agreement — this agreement, the Advertising Placement Rules, and other documents/rules governing the operation of azfilter.az and the procedure for using the services listed on the Website.

Services — functional capabilities, services, maintenance, and tools provided to users of www.azfilter.az.

Goods / Products — water purification equipment, cartridges, minerals, accessories, and other related items, information about which is posted on the Site.

Advertisement — information addressed to an indefinite circle of persons about an offer of goods (including contact details, photographs, and any relevant information) posted on azfilter.az.

Offer — actions of the User consisting of adding a selected item from the lists of goods/works/services on the Site to the shopping cart, entering the necessary data, and clicking the “Place Order” button (hereinafter — order placement).

Call Center — specialists interacting with Users via the “Contact number.”

Buyer — a User who views the Seller’s advertisements, interacts with the Seller regarding goods and/or concludes a contract with the Seller.

Website Login Credentials — a unique login (email address) and password that the User creates independently during registration or subsequently changes through the Personal Account or in another manner established by “Azfilter Group” LLC, and which are used to access the Personal Account on azfilter.az.

Personal Account — the User’s personal section on the Site, under the conditions offered by “Azfilter Group” LLC, where the User manages orders, sign-in/sign-out, and personal settings.

Registration — a series of actions by the User in accordance with the instructions of azfilter.az, including providing login data and other information using a special user interface form of kontakt.az, to create a Personal Account and obtain access to personal services of kontakt.az.

User Data — any materials and information provided by the User to “Azfilter Group” LLC in connection with the use of kontakt.az.

 

1. General Provisions

1.1. Regardless of registration/authorization, the use of the Site, including viewing posted information, signifies the User’s consent to these Terms, adherence to the rules for using the Services, and acceptance of responsibility for actions on the Site.

1.2. It is assumed that actions performed by the User on the Site (including making an Offer, entering into sales transactions, performance of work/provision of services) are for purposes not related to entrepreneurial activity. The User shall not subsequently acquire the right to request from “Azfilter Group” LLC documents not intended for individuals. In the event of a request from a legal entity or individual entrepreneur, a separate sale agreement (which may be in simplified form or otherwise) is concluded to enable the issuance of primary documents and payment orders. The procedure for concluding such agreements is governed by the civil legislation of the Republic of Azerbaijan.

1.3. By accessing azfilter.az and thereby entering into the User Agreement, the User warrants that they possess all rights and authority necessary to conclude and perform it: they are of legal age and fully capable, or have been recognized fully capable by emancipation, or are at least 14 years old and have duly executed written consent from parents or other legal representatives to conclude the User Agreement. “Azfilter Group” LLC may request supporting documents at any time.

1.4. The Services provided on the Site may be changed, supplemented, updated, and their functionality modified at any time without prior notice. The Services are provided “as is,” in the form and scope existing at the time of the User’s access. “Azfilter Group” LLC may terminate the provision of the Services (in whole or in part, temporarily or permanently) to all Users or any particular User without prior notice.

1.5. Product descriptions and prices indicated on the Site may change. The final price is specified in the Company’s acceptance of the User’s Offer (order confirmation). Information about products is posted based on the manufacturer’s technical and other data. In case of inconsistencies, the manufacturer’s documentation prevails. The Company may change information on the Site at any time without notice.

1.6. When placing an Offer (order), the User is responsible for the accuracy of the data provided and simultaneously gives the Company consent to process personal data that becomes known as a result of acceptance of the Offer. Processing includes collection, registration, accumulation, storage, adaptation, modification, updating, use and distribution (including transfer), generalization, deletion, and other operations necessary for maintaining a database of personal data. Using the contact details provided, the Company may also request feedback on the quality of goods/works/services, invite the User to participate in advertising/marketing activities, and inform (including via SMS) about campaigns, offers, and the Company’s activities. The User has the right to withdraw consent to processing, taking into account that the Company retains data within the limits required by tax and other applicable legislation.

 

2. Registration on the Site

2.1. After registering on azfilter.az, the User gains access to certain services.

2.2. During registration, the User specifies chosen login credentials. After entering the data, the User receives an email with an active hyperlink to confirm registration. Only one account is permitted per email address. Re-registration using a previously used email is not allowed. Registration data can be changed in the Personal Account or in another manner determined by “Azfilter Group” LLC.
The Company does not conduct special verification of the data entered during authorization; such data are accepted without additional verification and serve as the basis for processing the documents required upon acceptance of the Offer.

2.3. The User must ensure the confidentiality of login credentials and not disclose them to third parties. Transfer of credentials to third parties and/or allowing their use for authorization on kontakt.az is not permitted, except for persons acting on behalf of and in the interests of the User with appropriate consent.

2.4. Any actions performed using the login credentials or the phone number specified in the Personal Account are deemed actions of the User or a person authorized by the User and entail the User’s responsibility, including for violation of the kontakt.az User Agreement and lawful product-related claims.

2.5. If there is suspicion that the credentials have been disclosed and may be used without authorization by third parties, the User must immediately change the registration data.

2.6. “Azfilter Group” LLC may use technical means to verify the correctness of data provided when using azfilter.az; however, it does not guarantee the authenticity of the User’s identity or the accuracy of all information. Users are advised to use all tools available on kontakt.az to check potential counterparties and to exercise caution when conducting transactions and choosing a seller.

2.7. “Azfilter Group” LLC may block or delete a User’s account without the possibility of recovery.

 

3. Cookies

3.1. To ensure the best user experience, the Company uses cookies. By continuing to use the Site, the User consents to the use of cookies and to the Company’s receipt of corresponding data for providing relevant offers and campaigns. The User may unsubscribe and/or disable cookies at any time via their device settings.

3.2. Browsing goods/works/services and placing orders on the Site are free of charge. Internet access conditions are governed by a separate agreement between the User and the Internet provider and are unrelated to the Company.

3.3. Due to preventive, routine, and other technical works, the Site and the services it provides may be temporarily partially or completely unavailable. The technical service may conduct such works without prior notice to the User.

3.4. The Company reserves the right to unilaterally amend these Terms, subject to prior publication on the Site.

 

4. Rules for Rating Products and Posting Reviews

4.1. The User may post product reviews, comment on reviews of other users, and rate products by filling in the relevant fields on the Site.

4.2. Reviews, comments, and ratings are visible to other users.

4.3. The surname and name indicated during registration cannot be changed in a published review.

4.4. Reviews, comments, and images are published “as is,” under the login used during authorization, preserving the author’s spelling and punctuation. The User is responsible for the accuracy of the information contained in the review.

4.5. “Azfilter Group” LLC may, at its discretion and without notice, select reviews for publication and refuse publication, including where:
— the content is not related to the store/product;
— there is no useful information;
— offensive expressions are present;
— the text contains links to other websites, mentions of sellers/importers, or statements defaming honor, dignity, and business reputation of third parties;
— third-party rights are infringed (including intellectual property rights);
— there are links to external resources, etc.
The Company may remove published reviews/graphics/comments/ratings/collections at any time and independently determine the publication period. The Company is not obliged to report reasons for refusal or removal.

4.6. The User agrees to receive a bulletin with responses from representatives of “Azfilter Group” LLC.

4.7. The User agrees to receive advertising messages in accordance with Article 23.1 of the Law of the Republic of Azerbaijan “On Advertising.” The User may refuse to receive advertising messages.

 

5. Purpose of the Service and General Conditions for Placing Orders for the Organization of Delivery of Goods

5.1. By placing an order, the User acknowledges that “Azfilter Group” LLC may entrust the organization of delivery to a third party; however, responsibility for delivery to the User rests with the Company.

5.2. Prior to placing an order, the User undertakes to familiarize themselves with all terms of service provision and conditions for purchasing goods posted on azfilter.az. Errors in descriptions of services/goods do not have legal force. Placing an order signifies the User’s acceptance of all essential terms for “Azfilter Group” to provide services for the sale and delivery of goods.

5.3. The User confirms consent to transfer their personal data (including when ordering, paying, registering, submitting return requests) to the following persons and for the following purposes:
— to a third party engaged by “Azfilter Group” LLC for organizing delivery, providing services, and concluding agreements;
— to a financial partner — to confirm transactions when paying for goods in the Service and to provide personalized services.

5.4. The User acknowledges the right of “Azfilter Group” LLC to store the User’s personal data and the data of the order recipient for the duration of the Service use and for at least three (3) years after the last use.

5.5. The User warrants that they have the right to provide consent on behalf of third parties (recipients) and is liable for losses, lost profits, court costs, and expenses of the Company arising from a breach of this warranty.

5.6. The Company may use personal data to improve service quality.

5.7. By placing an order in the Service, the User agrees to receive:
— e-mail/push notifications: after order placement; upon changes; prior to the delivery date; upon store cancellation; and in other cases affecting performance;
— SMS messages to the specified phone number;
— phone calls inviting the User to evaluate the quality of the Service/Seller.

5.8. By placing an order, the User confirms that:
— they are fully acquainted with these Terms;
— they understand the essence and conditions of agreements with “Azfilter Group” LLC for the provision of services to organize delivery;
— they fully understand the meaning and consequences of actions related to such agreements.

5.9. “Azfilter Group” LLC may restrict the ability to place orders in cases of repeated cancellations or violation of these Terms.

5.10. The User must provide accurate information about themselves and the order recipient. Indicating an incorrect/non-existent phone number, email address, full name of the recipient, or other inaccurate information is equivalent to refusal to receive the order and constitutes grounds for cancellation under Section 7.

5.11. Information on stock availability may change by the time of order placement due to technical reasons.

 

6. Order Placement. Conclusion of an Agreement for Services to Organize Delivery of Goods by “Azfilter Group” LLC

6.1. An invariable condition for submitting an order to the Service is the User’s conclusion of an agreement with “Azfilter Group” LLC for the sale and delivery of goods, posted on kontakt.az.

6.2. The User provides all information necessary for performance of the agreements, including personal data of themselves and the recipient, delivery method, address, recipient’s full name, contact details, and payment method.

6.3. The agreement for services to organize delivery is deemed concluded when:
— if payment upon receipt is chosen (cash/card to courier) — after clicking “Place Order” (or an equivalent button) and confirmation that the order has been sent to the User;
— if prepayment by card is chosen — at the moment of clicking “Place Order” (subject to confirmation that the order has been sent). The User has 10 minutes to make payment; if not paid within this time, the agreement with “Azfilter Group” LLC is not deemed concluded.

6.4. Performing the actions specified in clause 6.3 constitutes full and unconditional acceptance of these Terms and acceptance of a public offer within the meaning of Article 409 of the Civil Code of the Republic of Azerbaijan to conclude an agreement for services to organize delivery.

6.5. At the moment specified in clause 6.4 (unless otherwise provided), mutual obligations arise:
— between “Azfilter Group” LLC and the User (agreement on provision of services for sale and delivery);
— between the Seller and the User (civil relations for sale of goods, transfer, and payment, etc.).

6.6. By performing the actions specified in clause 6.3, the User confirms that:
— information about goods and services has been fully communicated;
— prior to concluding the agreement with “Azfilter Group” LLC and purchasing goods from the Seller, the User has read all mandatory information required by consumer protection legislation;
— the information provided by the User and the recipient is accurate.

6.7. The Company may cancel orders containing goods from which receipt was previously refused 5 or more times for reasons not related to product defects.

 

7. Payment for the Order

7.1. The User is offered the following payment methods:
7.1.1. cash upon receipt;
7.1.2. bank card upon receipt (installment via terminal is not available);
7.1.3. cashless payment when placing the order on the Site (bank card or another available method).

7.2. Payment is considered made upon confirmation from the bank and credit of funds to the current account of “Azfilter Group” LLC (or receipt of cash by the courier).

7.3. A cash/tax receipt and other accompanying documents required by the Law of the Republic of Azerbaijan “On Protection of Consumer Rights” are provided to the User by “Azfilter Group” LLC (including delivery with the goods).

 

8. Order Cancellation by the Seller

8.1. The Seller may cancel the order if:
— the User did not pay for the order (when using methods under subclauses 7.1.1, 7.1.2);
— the User does not agree with the delivery time and a new time cannot be coordinated;
— the item is out of stock/damaged;
— other circumstances prevent fulfillment of the order;
— the User refused the goods in cases provided by law;
— the User evades receipt;
— a technical error in price or unlawful actions of third parties occurred.

8.2. If fulfillment is impossible due to reasons beyond the control of the User/Company (e.g., changes in customs rules and procedures; loss of the shipment; absence of the item from the supplier; defects identified during processing; regrading or malfunction), “Azfilter Group” LLC cancels the order and notifies the User. The User may place a new order under the conditions effective on the date of the new order (price differences are not compensated if the previous order was not cancelled due to a defect).

 

9. Order Cancellation by the User

9.1. The User may cancel the order at any time before its transfer/hand-over.

9.2. If the order has not yet been submitted to the delivery department, it may be cancelled by contacting support (+994 55 222 32 54). The User may refuse part of the goods before the order is submitted for delivery.

9.3. After hand-over, the order may be cancelled in accordance with clause 9.4.

9.4. User’s refusal (return of goods):
— in case of courier delivery, the User may refuse only all goods included in the delivery;
— withholdings/settlements are made under subclause 7.1.3; if payment methods under subclauses 7.1.1, 7.1.2 were chosen, the User may be requested to transfer payment to the current account of “Azfilter Group” LLC.

 

10. Return of Goods by the User

10.1. Return of goods to the Seller is carried out in the cases and manner established by the legislation of the Republic of Azerbaijan.

10.2. A User wishing to return goods must contact +994 55 222 32 54 and inform about the intention to return.

10.3. Refunds are made after evaluation of the goods.

10.4. If visible or hidden deformations are detected, the amount is refunded partially.

10.5. If the consumer lacks the technical ability to return bulky goods, the return may be organized by “Azfilter Group” LLC for an additional fee.

 

11. Delivery and Handover of Goods to the User

11.1. Delivery to the specified address requires the User to be present at the agreed time.

11.2. The courier does not provide consultations on operation, features, installation, or configuration of the goods.

11.3. If the delivery method is chosen and there is no option to check technical specifications at the pick-up point, “Azfilter Group” LLC may refuse such verification.

11.4. Verification of goods’ conformity is carried out only in the presence of the courier/issuing person.

11.5. The order is handed over to the User or the designated recipient. If it is impossible to hand over a cash-on-delivery order to these persons, it may be handed over to a person ready to provide the shipment number and/or recipient’s full name and to pay the full price.

11.6. After the warranty card is filled in and the courier leaves/the goods are removed from the pick-up area, claims regarding delivery, appearance, and packaging are not accepted.

11.7. The order is deemed delivered upon signing the accompanying delivery documents (including in electronic form). The User agrees to such signing on the mobile device of the courier/issuing person.

11.8. The courier/salesperson may request an identity document and the order number.

11.9. Delivery outside the Republic of Azerbaijan (export) is not performed.

 

 

 

12. Services for Organizing Delivery

12.1. The cost of services for each order is determined by the prices indicated at the time of ordering. Delivery times are indicated in the Service. Prices may be changed unilaterally. If the address is changed within the same locality, the delivery cost is not recalculated. When changing the delivery zone, the fee considering the distance is not refunded/reduced.

12.2. The User must pay for the services in the manner specified in subclauses 7.1.1–7.1.3.

12.3. In the event of complete loss/destruction of goods from the moment of dispatch by the Seller until hand-over to the Buyer, “Azfilter Group” LLC refunds the amounts paid in advance.

12.4. The Company is not liable for non-performance/improper performance if:
— the User violated these Terms;
— the User (recipient) was absent at the delivery address at the agreed time;
— it is impossible to contact the User (recipient) using the contact details specified when ordering;
— force majeure occurred (natural disasters, interruption of communications, avalanches, wars, fires, floods, earthquakes, and other acts of God, as well as other circumstances beyond the affected party’s reasonable control);
— the shipment was delivered sealed without external damage/interference;
— the User failed to take the necessary actions to receive the goods at the pick-up point in accordance with the delivery rules and conditions specified in the Service.

 

13. Other Provisions

13.1. The User confirms that they are legally competent and have reached the age required by the legislation of the Republic of Azerbaijan to perform the actions provided for by these Terms.

13.2. If the User violates the Service’s terms of use published at the relevant link, “Azfilter Group” LLC reserves the right to cancel the User’s orders. The Company independently determines the methods and grounds for recognizing the User’s actions as unfair and/or violating the Rules and may refrain from disclosing such information to third parties.

14.3. “Azfilter Group” LLC is not liable:
— for temporary failures/interruptions in the operation of the Site and any resulting loss of data, security issues, or the accuracy and timeliness of data transmission, except as provided by the legislation of the Republic of Azerbaijan on personal data;
— for the reliability, quality, and speed of the Site and the security of data created/used/received by the User, except as provided by the legislation of the Republic of Azerbaijan on personal data.

 

Pricing Policy

Pricing policy on the Site and in stores

Special campaigns. Certain offers may apply only in physical stores or only on the Site, which may lead to differences.
Geographical differences. Prices in stores across different regions may vary due to economic conditions and logistics costs.
Special discounts. Specific stores may offer special discounts, which may result in discrepancies with prices in other stores and on the Site.
Stock differences. Depending on stock availability, prices in stores and on the Site may differ.
System updates. Temporary price discrepancies may occur during technical updates and are eliminated shortly after completion.

Complaint Management Policy

Our goal is to delight customers with high-quality services and products. As a company committed to continuous improvement, we take our complaint management policy very seriously.

1) How to contact us?

A dissatisfied customer may submit remarks via:

the feedback form in the Contacts section on azfilter.az;

the online chat on the Site;

calling the Call Center: +994 55 222 32 54;

social media.

 

2) Information the customer must provide

For prompt and effective review:

Full name and contact number;

Name of the staff member who provided the service (if known);

Nature of the complaint.

 

3) Feedback to the customer

We strive to resolve issues on the spot, though this is not always possible.

Registration of the complaint is confirmed within 3 business days; a preliminary review is performed and, if necessary, additional information is requested.

We aim to resolve the complaint within 10 business days; if this is not possible, we inform the customer of the reasons and the nearest resolution date.

Upon resolution, we inform the customer of the outcome and every step taken by us in writing (or orally by mutual agreement).

The customer may contact us at any time to inquire about the current status of the complaint.

 

4) Main stages of complaint handling

Registration: within 3 business days.

Preliminary review: we may recontact the customer to obtain additional information and clarify details.

Investigation: within 3 business days after registration — an impartial and objective review based on the information provided by the customer and available to us.

Response: we inform the customer of the result and actions taken.

Adjustments: we make changes to policies/procedures as necessary.

Confidentiality: personal data are processed in accordance with the applicable data protection legislation.
